Somebody's ass is grass. It's illegal as all getout. ARNG soldiers are legal if the State Governor authorizes it, but not USAR or Active Component.

Having said that, would any soldier stand by and watch a massacre if they thought they could stop it?

Samson is a small town just over from where I grew up (same as Kinston). It's awful what happened there, especially the child.

That said, military had to have been called in by someone. I doubt that the soldiers would have gone on their own volition... although it is possible.

WTF Posse Comitatus , personally I'm glad they came out to help. I'm thinking this won't go well for someone, but at the same time, it was what was needed at the time. Get over it.

so far the facts are:
someone called the MP's and asked for help
nobody gave order
troops were indeed there


now my understanding of posse comiatus is that it prevents commanders from sending military into police civilians.....what happens when they are requested?


18 USC sect.1385

Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.

i do not see 25 MP's responding to a plea for help from a small town police department as a violation of 18 USC sect. 1385
