Is it falsing back into neutral ? If not, it could quite very well be many things.
What makes you 100% sure the clutch is NOT burnt out? If you let it cool, then fire it back up later on adn it rides fine, sure sounds like a clutch to me.

Need a little more info to help. Does it shift into gear? How many miles on the bike?

When this happens, have you tried to pull in the clutch, and "downshift" back into first again? if so what happens?
I HAVE TRYED DOWN SHIFTING, IT STILL WILL NOT MOVE. I CAN GO THROUGH ALL THE GEARS, I CAN GET THE NEUTRAL LIGHT ON. NOT SURE IF IT 'S ENGAGING LIKE IT SHOULD, BECAUSE I TRYED IT AGAIN, NOW I CAN RELEASE THE CLUTCH WITH BIKE IN GEAR WITH IT ON AND WILL NOT CHOKE OUT LIKE IT SHOULD.

sounds to me as if the clutch assembly is sticking. You can either check the clutch assembly out yourself, or take it to a shop.
