Does This Look Right??

I was checking my air filter and have a question. Does this flap in the air box supposed to be open {see attachment}? This is my first Busa that I bought used and have no clue if this is right. Thanks.

yes, it will be open when the bike is off, or above 2500 rpm

Thanks everyone, didn't know if it should be open or closed with bike off. Yea I need to get the junk out of there, that's just what was left, I swear there was a small tree growing in there!
