Yes, he's in CA, so splitting is legal. Although if I recall you are only allowed to do it when traffic has slowed down below a certain threshold, and you are only allowed to go like 10-15 Mph faster than the traffic.

Made that Busa look slow but when a MC is passing it's best to let them go by anyway, I remember a kid that probably didn't know the protocol about breaking a formation so he rode right through one and a particular Diamond club followed him and aggressively educated him on the matter.
