I'd like your opinion on a few legal issues

Lately I've wondered how the system got so messed up. I've read about a few court cases lately, where people are placed in jail or on bail YET they havent been found guilty yet. How can that be justified? Lets say they take you to jail and you are there for a week or months then you go to trial and are found NOT guilty. Is it you are simply free to go? Or shouldnt you get paid for your time in jail and stress.. I think if they had to pay you if found innocent then they'd make dang sure you did what you are charged with. I mean if you make a mistake arent you fined ? yet when Ceaser makes one its ohwell... Thats not right or fair..
I have a friend that was arrested a few weeks ago.. He had 2 loaded pistols in his car in boxes under the seat. Trooper pulls him over for speeding , asked if he has any weapons. Dudes says yes under the seat .. he gets hauled to jail ( no priors) sits there for a week before bail is set. get his guns taken ( he isnt guilty YET) . Now if he had is Gun permit it would have been ok . So basically You have to pay for your American Constitutional rights! I thought thats what alll the American soldiers have been doing over the years. fighting to keep us free.. I remember I raised my hand and Swore to protect the Constitution...
I'd just like your toughts on how the system works
 
Same thing happened to me, but it was in New Jersey where a NJ resident doesnt have an option of a carry permit. I was coming home from a shooting range and was pulled over. He seen my shooting bag on the back seat and asked, Do you have any weapons, I stated yes I have an unloaded pistol in its carrying case under the passenger seat. WELL DAMN YOU THOUGHT I JUST KILLED SOMEONE!! within 2 mins 5 cop cars come blazing in!
Pulled me out of the car arrested me and took me to jail and impounded my car.
Long story short..... Got a lawyer Evan Nappens in NJ and didnt even goto court it was thrown out, but you talk about a bunch of chit!!
One of the many reasons I left NJ and will never return to live!!! Holding my hand up and giving the message #1 to new jersey.:moon:

I have a friend in Ireland and he says it 5 yrs.in jail for a pocket knife ( same in Brittan I'm told) . Now since the UN istrying to create a global society do ya think they're going to leave our guns alone here??? I think the plan is to make everyone and everything illegal. then they have the excuse to disarm... You cant say this or that , Calling someone a name is a Hate crime ! next it will be a feloney to flip a bird .. It just doesnt end.... sorry about my bla bla bla
 
System sucks sometimes but compared to some of the others out there I 'll take it.

Some systems they don't bother with a trial they say did it and thats it, they lock you up and for get about ya.
 
Best know the firearms laws in the jurisdiction you are in or traveling through. Generally, transporting a handgun under the seat is going to be a problem.

Legal to pocess per the 2nd Amendment and carrying it in your sock or under the seat isn't the same legally.
 
For some reason carrying a gun under the seat makes police think your a crook?
In the console or glove box and they react differently? I've encountered both scenarios and the Leo that stopped me when it was under the seat had a kiniption. Other times it's no problem elsewhere.

PocketRocket the American system is the best of the worst. Nothing but nothing better exists anywhere in any other country but it's not perfect. We are pretty much the only nation left where you can buy whatever you want. I can't think of any other country where you can go to a gunshow and walk out with an arm load of hi cap semi auto rifles and pistols and a smile? Slowly yes world pressure will try to overcome the 2nd amendment as well as pressure from within. Whether you or I give in or go down fighting is gonna be up to us.
 
Go down to your local court house and get a CCP, If you dont have one Pistols MUST be in plain sight on the back seat unloaded with action OPEN, Not to get a trip to Jail, IF you have a weapon under a seat or in a bag the police consider it concealed.
 
You have the right to bear arms, not stash them under your seat. Get a permit.

I don't think the founding fathers thought 200 plus years into the future and the implications a right to beat arms would have.

If you dont have a CWP then guns have to be out in the open otherwise they think you are hiding something.Yes we have second ammendment rights but there are by-laws to go by.Loaded guns under the seats seems kinda shadey at least to a cop.So if you want to conceal your weapons, get a CWP.I carry in the car but never have it loaded.Still not right though.
 
I had my car broken down on the side of the road when out of the blue a cop showed up. He asked what was going on becuase it was 3 or 4 in the morning. Then he asked if I had any guns in the car because he saw my 460 case on the back seat (had to send it to S&W for a recall). I told him about the gun and said I had a loaded gun under the seat and that I also had a concealed permit. He took that and my license and went back to his car. My buddy and me were trying to figure out who to call to get to work becuase we were going to poor concrete that day and there is no excuse for missing a 400yd deck poor. My buddy started calling people and I went to reach in my car for my phone and the cop jumps out of his truck yelling at me saying "thats not a good idea" WTF?! So I had to wait for him to take his sweet time to check my stuff. I couldn't believe it. I am used to people in Iraq rolling up to our check points with AK's sticking out the window. We didn't even treat Iraqis like I got treated. I think it's rediculous the way police treat people with guns in our country that have them legally. I also agree with you that the justice system is rediculous. Tough luck for your buddy.
 
There are two sides to this. Just because you were honest and told him about the guns doesn't mean you aren't still gonna shoot him...

Florida does not require you to have a permit to carry it in your car. The weapon can be loaded as well. It can be anywhere in the vehicle you like.
If you do not have a cwp than it cannot be on you but you can still have a loaded pistol and it will not be considered an illegal concealed weapon. Loose, loaded and under your seat they will frown upon and bust your balls for as long as they can but in the end you have broken no laws here.

So what do we do when they tell us we have to have a permit to keep our guns at home? or you're allowed to have them but we must leave them at the local PD and sign them out.. or you can only buy ammo at the range once you have your permit and day pass to carry ..
I just always thought our Rights were God given and fallowed me 24-7. If our right to have a weapon only exist at home ,then are our rights cancelled as an American once we are in our cars?

I have heard "rumors" az is making/made legal for anyone to c&c, might be only some counties but thought it was cool. If u want to talk about bs, move here to Cali then you can enjoy our gun laws....

In the state of arizona u can legally conceal and carru without a permit as long as u are not a gelon and have the legal ability to purchase a firearm. There are a few exceptions to not having a ccw permit, would have to look them up
