ticket question

hey can anyone tell me how VASCAR stands up in court. i guess i need to tell you more of the story. me and a buddy was coming out of Buford Ga 985 to 85 and we were pulled over and the officers told us that there police helicopter tracked us. mind you when they pulled us over they could not tell us how fast we were going. they wanted us to tell them. so he gives us both tickets for 90+. don't get me wrong the officers were really cool not attitudes or anything. they were just glad we didn't run.

VASCAR is not helicopter.. I thought VASCAR was the original "moving target/moving LEO" system that tied into the speedo system..

I think all the "air" guys have to use painted reference lines and timers..

I would try to find out just how exactly they clocked you. If they timed you with a stopwatch, and paced you on markers, you may have an out. Human error says there's no way to accurately clock you this way. CA doesn't even allow "timed" speeding tickets, cuz it's considered a "speed trap", which is against CA law due to inaccuracy. I know that CA is not GA, but it's ammo for the cause.

If they paced you, you can argue that using air speed to compare road speed is inaccurate because many factors come into play on air speed. head wind, tail wind, etc.

I'd go to court on it. Ask for proof of your speed.

None of this would play in if they were using (which I would suspect) a GPS to get the speed. That does not say they were pacing you to get your speed though.

cool, did not know that CA stopped that practice... (me never had speeding ticket in 1.5M miles)

VASCAR (Visual Average Speed Computer And Recorder) is a vehicle speed measuring system that computes speed from two variables, distance target vehicle travels and the time it takes to travel that distance. Distance can be measured using the patrol vehicle odometer (the VASCAR computer is connected directly to the odometer), or entered from a keyboard inside the patrol vehicle.

Unlike many Police Radar Guns, the basic operation of VASCAR has the officer visually select any two landmarks (utility pole, crosswalk, sign, etc.), determine distance between landmarks (already known or measured with patrol vehicle odometer), and measure the time it take a target vehicle to travel between landmarks (push a button when target passes each landmark). VASCAR radar can be used by a stationary or moving patrol vehicle. In moving mode distance between landmarks is determined on the fly by the officer pushing a button when passing each landmark.

VASCAR radar has an advantage over microwave radar (most Police Radar Gun) and laser radar in the fact that a radar has to be close to the road, while VASCAR can be close to or far from the road. The operator only has to see vehicles pass between landmarks, making VASCAR more flexible (easier to hide patrol vehicle) Police Radar Guns. Also VASCAR does not transmit (microwaves or laser infrared signals) and does not alert a driver equipped with a radar detector.

go to court and ask for a PBJ (probation before judgement)and they should lower the points and fine uinless your a repeat offender ..oh yea, the helicopter was in case you decided to run..

Whatever you do.........make sure you go to court and "try " to fight it or get it reduced. Its well worth a loss of a days work to go to court and "ask for a reduction" plea with an exuse, something like that.A guy at work says he never just pays the ticket,he always goes to court and its ALWAYS alittle LESS!
Hope this helps you.

alot of times they dont even show up. in your case they might. but since they were cool about it all it might not be worth the hassle to them

I didn't mean to say to hassle them or fight it.but more of a point of showing up in court as opposed to just paying the ticket.

I'm with ya. I agree 100%. My bro. in law use to get tickets alot! He would go to court and if the cop showed up then he had to pay. 99% of the time the officer wouldn't go. From talking to other friend officers it just isn't that big a deal to them that they would want to go to court just to uphold a speeding ticket.. They know everyone speeds..so if you want to take time out of your life to go to court than you are more than likely to be more careful in the future
