I wasn't sure where to post this so I thought this would get the most exposure.

A local friend of mine from BC, Canada, was in Washington State and was caught doing a wheelie and speeding on his GSX1000 a little over a month ago.  He received a court appearance notice for wreckless driving and went down to court yesterday after taking 10 hours to get there.

Needless to say the prosecutor never showed up but the judge said the prosecutor would be in touch by mail and/or phone to "work out a deal".

To me this seems to be a big waste of time if the prosecutor didn't see the case important enough to show up for and waste everyone's time and money.  What do you guys/gals think about this 'deal'?  Comments/Thoughts/Ideas/Suggestions?
 
Wow! I can't imagine any of our local judges not droppin' the case, or at the very least giving a court warning, seein' as how he travelled 10 hours for court!!! Geeesh!!! If I were your friend, I'd see if I could get an attorney try and handle this by phone and have the whole thing dropped since he was inconvenienced to that extent due to their problem with gettin' their prosecutor to court. Just my $.02 tho...
 
Should of been thrown out as soon as the prosecuter pulled the no-show

Bad move(forget about it).....if the judge has left this open, it's unsettled, and could eventually end up as a traffic warrant.
Sure it SHOULD have been thrown out , blah blah blah....but it wasn't . So if yer buddy ignores it ICED , he could get a BIG hassle next time he crosses the border.

Unfortunately , things like driving 10 hours to get to court are not taken into consideration , in other words...the courts dont give a fug .

My advice....I would wait for them (US courts) to call me.That is if....
yer buddy is not in a hurry to go back down. Let it sit until a month or 2 before he wants to go back , then he should call them . See if there is a warrant . I wouldnt ignore their phonecalls or letters thou , sounds like his name is still floating around in the system .
If he ignores it , and they write up a shiddy warrant , they wont come to Canada to collect him....they will arrest him thou if he crosses their path in Wash . state again .
Could ruin yer day , if yer just down there parting or hangin with friends .

tell him to fix it....b4 he tries to go back down....

have a good 1.......RSD.

Tell him not to play the waiting game...He needs to contact the court preferably by letter and registered mail...Once he does that then he puts the monkey on their back...His letter needs to include the issue of his first appearance and the prosecutor not being there and a request to the court that the matter be dismissed...If the court still refuses to dispose of the issue then he should request a court date, unfortunately return and handle the matter...Here in the states we have what is called a "Violator Compact Law"...It simply means that even though I possess TN lic, if I were to get a traffic citation in CA that CA could suspend my TN lic for Failure to Sastisfy the CA citation...I would not imagine that we have that sort of agreement with Canada but you never know...That might be worth some research on your friends behalf...But by all means don't wait and don't ignore...

If he uses a passport to cross into Washington they will flag his warrent at the border and have his situation assessed at that time. Maybe arrest him. Since 9-11 the computers flag all warrents in the US at ALL customs check points. Be careful.
Also he probably will be able to settle for a lesser fine and just pay it since there was no prosecutor present for the initial hearing.

Gotta be extra careful when cruising Washinton state they have ticket nazi's everywhere and unmarked cars too.

Don't need a passport to enter from Canada or Mexico to my knowledge. Point still remains that they will catch you when you cross and show your ID, I would think.

just went from Can - US...couple weeks ago...they asked for my passport, if I didnt have it,would they have let me go thru? I dunno. Having it sure speeded up the process .
I would still strongly suggest clearing this matter up,before he goes on his next holiday .

Chances are....IT'S NOT GOING TO GO AWAY.

Why would you even want to GAMBLE yer good time.

EXAMPLE: yer with ten buddies , everyone gets thru but you , 'cause of some shiddy warrant thing , now yer gonna fug up everyone's good time . They gotta wait for ya...or feel guilty about dumpin' ya .

Why take a chance....its a couple hundred bucks probably.

Like that stoopid fuggin commercial says....fix it,an' forget it.
 
I agree with WSD... I used to cross the border into the US all the time as a visitor 8 years ago. Can't imagine what those homeland security computers have on them to spoil a visit today.
