Long winded legal question...

As others have stated your first mistake was admitting anything. Next time just distance yourself from her and if you feel that she was in fact trying to run you off the road pull over somewhere safe and report her. Road rage incidents rarely end well and its best to distance yourself and report a serious situation and not provoke it. I would speak to an attorney as soon as possible.

If you do a Google search for "County Bar Association," you should find your local Bar Association. Check them out to look for lawyers who can help you.

A quick little story here:

A few years back one of my friends took his bike to make a trip to the parts store. Along the way a woman began following what he perceived "Too Close" so he blinked the brake like a few times which he intended to say "Back off a little". She called the cops and followed him to the parts store. Cops showed up, ask what happened and he gave his side of the story. They wrote him a "Reckless Driving" citation for brake checking this woman. Reckless is very serious business in the state of Washington. The end product was several thousand dollars spent and a reckless on his driving record. Unbelievable but true.

The attorney I use for traffic citations tells me if I keep my mouth shut he can get me out of anything but the more I chat with the cops the harder it becomes for him to remove the noose from around my neck. I paid attention to his recomendations and he has won every ticket for me over the past 15 years.

If you pursue legal assistance, I would recommend finding a successful "TRAFFIC" attorney.

u got that right Tuf! the only time I might refute that is IF you are 100% positive that you did nothing wrong.

but, if u screwed up trying to talk ur way out of lie usually makes the chit u've stepped in only deeper. cops have heard it all and MOST ppl think they are slick and are going to talk their way out of trouble. they arent and they dont. they usually end up taling themselves into deeper trouble....

like in the show "The first 48" if 90% of those people in the box just shut their mouth 50% of them would walk cause most of the PC the police develop is from them being tripped up in the lies they have told. they feel they are busted and either confess or lie so poorly that they look so even more guilty then they did when the police had nothing....

Ive noticed that, they always go for the confession as they dont have much hard evidence for a trial, and sure enough, those idiots start blabbing. I mean, Im glad they do, but its amazing how well they dig their own grave:laugh:

Bad situation altogether. I really do hope the best for you. Sure some $$$ will come out of your pocket and time out of your schedule before it is all said and done.

You really have two options in a situation like this on a bike- aggresively accelerate and get ahead of all traffic, or hang back and observe the traffic. Close calls can influence this decision. We've all been in your situation (seeing red) and wanting to retaliate against a cage driver. But, after having a car cause me to lowside last fall, I can assure you that "almost hitting me" is much better than "causing me to crash".

Bottom line is you damaged her property. Doesn't matter if it was a POS- it is her POS, not yours. Don't kick tires or smack mirrors- just not a good idea :2cents:
