I hate to play devil advocate here (glad you are ok) but that looks like a local/county/city street or road?

If you were doing by your own admission at least 70mph dont you think that could be a contributing factor? I am sure the driver would have guessed you might be doing more the speed limit?

Help me out here, does the car not have an airbag and what was the speed limit?

Airbag on that car won't go off unless the safing sensor (takes 2 sensors being hit to deploy the airbag)was also hit with the sensor that is behind the left headlight. It would have helped for this type of hit for the bag to go off but there are other ways the car could have taken the hit and only hit that sensor behind the left headlight that could end up hurting someone more than saving them. They worked like they where made to in this case which sucks. Man you had alot of work done to that thing, tubular k member and A arms, 5 lug conversion, looks like upgraded brakes....man glad your ok and sorry to see the stang totaled.

gota love those roll cages!!! I had a buddy in a civic with a cage like yours hit a light pole at around 90. Shaved the pole off the ground and totaled the car but he walked away with only bruises like you, could see hes harness marks for a about a week.

glad you were able to walk away with only bruises...just because they don't have the necessary circumstances to write a ticket doesn't mean the other driver wasn't at fault for causing the accident...i would definitely be talking to a lawyer about my options...i'm not one to try to bleed them dry but i would want my vehicle replaced without having to put it on my insurance
