so...get back yesterday after a ride up the coast with busahaya + eynlai (wassup guys? good riding with y'all). Park the bike in the garage, close + lock the chain-link fence but leave the steel roll door open 'cause I'm heading out to get some stuff to BBQ. Head upstairs to take off my riding suit, + about 5 minutes later I hear my wife yelling out the window, down toward the alley (and the entrance to my garage). She yells for me + says that someone has climbed the fence and is walking into the garage. I come down, look out the window, and there's a 16-yr old kid standing at the entrance to the garage. We have a short conversation:

Me: F*** off.

Him: What's the problem?

Me: You really need to get on the other side of that f***ing fence RIGHT NOW.

Him: Why are you cursing?

Me: Because I like to. What part of get on the other side of that f***ing fence DONT YOU UNDERSTAND?

Him: What's up? What's the problem?

Me: F*** this, and f*** you. I'm calling the cops, and I'm coming down there.


Grab my cell phone, and fly downstairs. Call the cops. Busy signal.

Get into the garage, and he's wisely gotten off the property and into the alley.

Him: What's the problem? Why are you yelling?

Me: You wanna stand right there? It'll be easier for the cops to get you, a**hole.

Him: F*** you.

Me: Go f*** yourself, b**ch.

He starts to saunter down the alley with his friend. I head to the front of the house, try the cops again with no luck. I walk down the block (which runs parallel with the alley), so I can see where this guy is headed. Out of pure luck, a police SUV is sitting at the corner. I give them a description of the guy, where he was headed, and they had him in less than 2 minutes.

He never managed to get anything, so it's a misdemeanor (trespassing), and since he's 16, he basically get dragged to the station and his parents get to pick him up. The cop figures that his parents wouldn't care, and would be more annoyed about having to come down to the station than anything else. Still, I'm really glad that I put at least a small kink in his day.


I don't think he could have gotten the Busa, since he would have had to a/ unlock the steering column, and b/ get it though a locked fence all while not alerting my wife and I who were just upstairs. Probably wanted something smaller that he could have snuck in and gotten out with quietly.

A few neighbors actually saw the guy climb the fence, but my wife called down to him before they could yell at the guy. They watched him walk down the alley afterward and apparently they looked in every parked car in the alley, looking for something to steal.

Needless to say, the heavy steel-roll door is now always closed and locked (this place is a bit of a fortress when it's closed down, thankfully).

Even tho he's hardly going to get punished, I'm glad I pressed charges anyway, even if it means going to court. Fugg him.

He'd been dead once he was inside the garage, no questions asked. But then again, if someone was stealing my bike I wouldn't had grabbed a PHONE to confront them with. Rethink your actions next time or they might be your last.
 
should have ran down and beat his A**,,thats just me though,,or grabed a pellet rifle and gave hima good sting in the a**,,that way he could have had a good memory of what it feels like to climb someones fence

While your actions were "probably" the most politically correct and "Legal" actions

I don't think I would have handled it that way.

I think I would have politely asked what he was doing. Then asked why he jumped a locked fence. at which point I probably would have explained to him it would be best for him to leave because I don't feel comfortable with someone jumping my fence to get onto my property.

At that point he would have either left or he would have been personally and physically escorted off my property myself.

I have always said that most of the time law enforcement are an "after the fact" entity.

Not always, but I would say most of the time. Not their fault, I have total respect for police. It is just the nature of the beast.

And to get a busy signal when you are calling them? Fugged it, you are helping them out by dealing with a 16 year old punk yourself.

I wold however keep a very close eye on your shid for the next few months, sounds like he might have not had intentions to do anything at that moment, sounds like he might have been scoping you out for a future special ops on you if you know what I mean..

Did you have a good view of the garage from your window? I woulda told the wife to hush an be quiet....and let the thieves into the garage. I'd grab a rifle an some ammo....and nail the fuggers as soon as they popped outta the garage with the bike. No kill shots...just a good shot to the leg. Mebbe even lower back. That'll keep em from climbing the damned fence and gettin away.

And I wouldn't have stuck my head out the window...I'd go stealth until I actually see 'em with my stuff. Then it's open season on scumbags.

would've loved to do any of those things. When I headed downstairs, it was with full intentions of beating his a** (I've been told that I can have a bit of a temper, to say the least), and had thought of a length of pipe that I knew was sitting in the courtyard at the entrance to the garage for just that purpose.  He had gotten out before I had the chance.

A few reasons I'm glad it didn't come to that (as satisfying as that might have been...)

- it would have cost me a fortune in time and possible lawyer fees - just to clear myself out of the system in the name of "self-defense".  I don't think I'd be in any real trouble down the line, but if I ended up seriously hurting this guy, there's no way the cops are just going to let me go, and I'm going to have to deal with that crap in one way or another. This kid's family - who prob. doesn't care about him - would come out + twist it that their "baby" was maimed by this "monster" - the typical stuff that you can catch on the news on a weekly basis...laughable, but I'd still be stuck in the midst of it all.

- It did cross my mind later that there is the chance this kid is gang-related; a very real thing around here (two people killed in a drive-by last summer just down the block), and even more likely during a summer weekend - we get all kinds around here this time of year. I don't need my wife to worry about walking out the front door for fear of some stupid revenge bull...

- I DID NOT want him entering the garage and the house, 'cause I WOULD have killed him - or close - if he did. Again, satisfying, but it also creates a LOT of messy problems that this kid just isn't worth.

All that said, this kid really shouldn't show his face anywhere around here for a long while; although he might just be stupid enough to do it...

Fla statutes- Castle Doctrine- if the perp is in your home, not simply on your property, you can use deadly force even if he attempts to flee once accosted. Outside of your home you must be in fear of "serious bodily harm" (not fear for your life like the general public seems to think), and if he attempts to flee you have to let him go. I would hope the laws in Cali would atleast be similar.

more then anything - it makes you more aware of "Hey, we gotta keep our #### locked down." Luckily he didn't get away with ####. Sounds to me like it his first in what will be many convictions. You did EXACTLY the right thing too. In California the laws aren't like they are in the south. You shoot the ####### and end up in Jail yourself.
Get yourself a Tazer. Its fun watching an ####### squirm on the floor getting tazered. Give yourself some laughs waiting for the Police to show-up.

keep an eye on things you might wind up with broken windows or slashed tires friend of mine had similar thing called cops on kid and he had tire slashed and windows broken of course he police were like uh we will look into it but never caught the guy

Take that wifey of yours out to dinner and shower her with love.You handled that very well and I'm glad the kids didn't burn you for anything....My approach to the situation and choice of words would have been totally different though.I would have let him get in the garage just so I could get close enough to plant the soles of my size 11's in his arzzzzz and then I would have called 911 to report that the focker has fallen and he can't get up.

Just remember that if the kid is under 18...becareful about harming him physically...unless he has a gun...then all ebts are off!

You did the right thing...lucky the cop was nearby....press charges, go to court, don't let him get off on this one! Who knows how many times he's done this, definately NOT his first...he was too brave about it...or stupid....depending on how you look at it!

Glad it was handled uneventfully, but I doubt it will be the last encounter. I think I would have gone down with a little more than a phone though.
 
Good job, I definately agree with how you handled it. Except I would've had my shotgun in easy reach when you went downstairs(I wouldn't let the perp see it) just in case the punk was armed.

Be careful the next few months once he's free. He probably won't do anything, but be cautious just in case.

Definately press charges. Make sure this is the start or a continuation of his criminal record. Don't let him off!
