hey guys, i don't know weather this is the right forum but.....

i was arrested for dwi 2 nights ago in NY(flushing). I have a NJ liscence. Spent the night and most of the next day in jail, until my arraignment. My car was seized and they're telling me that it will take 3~8 weeks to get it back. My court date is on June 22, and the public defendent said i'd most likely get fined and a 6 month suspension.
Here's the question"
I was heard that my liscence will only be suspended in NY sate and my Jersey liscence will not be affected.
Is this true?
any lawyers or police officers out there?

anyways i'll be on my bike for the next 3 weeks at least..
thx

Not 100 % sure of the law.....but I thought you could only have 1 license.

im not a police officer or lawyer but my family are all cops, and as far as i know, your license will be suspended period, whether NY or NJ. but the good this is 1st time offenders is a fine and only 6 months suspension, however you will have to go to AA and another class before you can get your license back, i forgot what they call it but both classes will cost you a few thousand dollars. you can apply for a hardship license (to and from work only) in the mean time after your 6 month suspension until you complete your classes. Good Luck!

yea, that sucks dude... Only takes a drink here in CO to get a DUI... They keep lowering the limits and they are making us normal people ciriminals all the sudden...

I always direct peeps to lawyers for legal advise, but you should be suspended period. In SC law you can only have one license and must surrender the rest. Also suspensions will hit all compact states. Believe NJ is a compact state.

with the connectivity the PD'd have I wouldn't chance it. I bet that a suspended license would show up in another states PD's database as things now-a-days are more and more connected.

Yaaa -- you are pretty much hosed.
I went thru it a lot of years ago, jumped through all the hoops (classes, day in jail, community service, probation)and still lost my lic for the better part of 6 mos. What was even funnier was my lic got revoked and re-instated several times a week by mail. I was a mechanic so, a hardship lic wouldn't work for me as they have to know your exact route to work and back and what times you will be traveling that route. Seemed like a hardcore setup IMO, and I had to test drive cars all day on diff routes for diff diagnostics. Per my lawyer, I kept the most recent lic re-instated letter with me and made sure never to actually carry my licence to the dmv for any of the bazzilion times I had to go there. Physically having my lic and the letter was good nuf. I went about my business and never got pulled over again.
Bottom line is do not drink and drive!!!
I got nailed 24hrs after a binge and still blew positive !!

ok for myself if i have 1 drink i will not drive plain and simple. whitch i know 1 will not even get me a buzz.

This might be a stupid question, but if your liscence is suspended, how will you be on a bike? Ahh, never mind, I just read where your court date isn't until the 22 of June.

Not sure what the general feeling is, but it is sort of hard not to be judgmental about things like this - so I hope things work out for you, but I also hope you learn not to drink and drive/ride.

In Missouri, the license suspension includes the motorcycle endorsement as well. If your license is suspended, it doesn't matter what state you are driving in, you are driving illegally. Sounds like you are looking for loop holes to get out of the punishment you deserve if convicted. No sympothy here. Don't do the crime if you can't do the time.

Drinking and driving!!!!!! This is a lose lose situation. I don't want to preach but you have to make wiser choices in life. Oh well live (hopefully) and learn....... Good luck with all of your pending legal battles..........

Wait till you're all done with your classes and AA and have to fill out your
SR-22 . You'll be lucky if you can even buy a drink after you make your first insurance payment.
Especially with a Busa...
I remember reading an article about the total financial loss after getting a DWI...It was like $30,000 after the 5 years the insurance companies will be porkin ya. But hey, it could be worse. You could have killed someone and ended up doing 10 years in prison. I'd take the Insurance companies over getting porked by Bubba anyday.
Feel any better? Sorry man...I tried...

Hello, Officer Friendly here...... When your license is suspended or revoked in your home state you are N.O.L everywhere else. No Operators License. You are not suposed to have two license from diffrent states. In NC if you present a License and are revoked its a misdemeanor.

Dude - glad you got stopped by the cops rather than oncoming traffic.

Now take your punishment with grace and class and learn from the experience; don't drink and drive!

before jusgement is passed by heavy non drinkers- me included, what was your blood alcohol percentage? Was this a blow or blood test? Did you have a beer or a case?

If you were plastered I am glad no one got hurt, take your lumps. If it was some new rookie cop that smelled beer on your breath and nailed you, we need more info.
