Cap, Get a GOOD lawyer. I'm not very trusting of them either. I have a couple of firms that I use. I got the bigest ones in the area with the best rep. Then I went in letting them know what I expected THEM to do for ME or for them not to take the case. Shop around
 
And if they want to play hard ball, you can always tac on a few $$$$$ for stress, sleepless nights, mental anguish etc.......and if you have a girlfriend (yall broke up because they created a stressful enviorment for you or if you are married it's on the rocks now because of the stress......

Captain - one other note..... Call the hospital and explain the situation. Tell them you need some time and you're working it out with the insurance company. Hopefully they will tell you they will put it off 60 days or so....

I'm not crazy about attorneys either, but this sounds like a time you may need one. find one that will take you case on contingency. Basically, you don't pay if the atty doesn't get any money. The only issue with that is that they usually take 25-33%. In my case 25% out of court, 33% if it goes to court.

You may have ongoing issues with the wreck. Tell the insurance company (or your attorney) you want it to stay open. There is a lot hanging on this... Good luck!!!

Update.......

So we spoke to the Orthopedic Docs office, they stated that they made a mistake and should not have filed the Lein against me personally but should have the insurance company. That has all been straightened out... the docs office said they didnt realize this was an auto accident and they should have told us that they were going to take this action before we left.

THEN

I got a call from the adjuster that totalled the 07 busa, he offered me the bike at a price that was actually below what we were originally told. It looks like I am going to buy the 07 back and do something with it....

It's back on track now.....
