SCREWED by eBay seller...

I'm sorry - I just need to vent. I can't vent to my lovely wife or I'll get hit in the head. (Which at this point, isn't a bad response.)

So I've been waiting for years to get an undertail on my bike. I've wanted one since they're $200+. I find a used one, my color, for $50 in tact and just needed a couple of LEDs, according to the seller.

I get back from my Dad's funeral this week hoping for a ray of sunshine amidst all the sadness and there's the undertail! Freak! how cool!!

Uh oh - US PO - damaged it. The rivet hole is broken off and no where in site. Contacting the selling - they say - didn't get insurance. Sorry. Deal with USPO!! What a bast__d. I emailed back saying we could possibly work something out - now - no responses. Its unbelievable how un-trusting, un-motivated, people have become towards doing business with other people.

Vent....

I'm wondering if there is any way to make this work and make it look good. But with broken plastic, it's not like we can plasti-weld on another piece and paint it for the cost of the $149 items on eBay... unless... someone has an idea.

Thanks for letting me vent... Good to be back on the boards...

Body shops use some stuff that is liquid weld. We have a body shop next door at work and we borrow it at times.

Sorry about your dad.

Did you have an option to buy insurance and you declined? I probably would have helped, but from his end how is suppose to know you didn't break it on install?

If you paid with PayPal you do have a recourse. Sellers are required to ship it insured with a signature conformation or the buyer can contest the payment and get their money back. Are you sure you received it?

Post up some pics. You may be ablle to make a patch pannel and weld it on for only a few dollars.

+1

File a dispute anyway. He may be forced to give you a partial refund

I bought my $250 undertail for 80 bucks because it had a hole where a tire rubbed it. I fixed it for $20

I never read that the seller has to insure the item and do a signature confirmation? That's news to me but that should fall on the buyer to request that he/she wants the item insured not the seller. I've bought and sold on eBay many of times using PayPal and not 1x has a buyer or me as a seller requested that they should get insurance. If the seller is a good person then they should help to offer a solution for your problem. Who's to say that it was already broken before it shipped out? The risks of buying and selling on a online flea market. Hope it works out for you.

Buyers are entitled to a full refund if a item is not received as described. The item was not described as being broke and it is what was received that matters not what was shipped. So if you don't want to insure an item as a seller it's at your risk not the buyers.

if u used paypal, file a report with that seller and they will take care of u. I once got screwed on an item, only about $20 though, didn't receive it for weeks and was contacting the seller with absolutely no responses. Ended up filing a claim through paypal and eventually got re-imbursed for it. Not sure how they would handle a damaged item. Ebay/paypal are pretty strict about their "rules" for selling or purchasing items. When i was young and still living at my parents house, bought a cell phone case for $5 and 20 minutes later i decided i didn't want it so i didn't pay for the item. Long story short, my parents account was banned from ebay for a $5 purchase:rofl:, i thought it was pretty funny. Also, very sorry to hear about the loss of your father, lost both my parents a few years back and brother went missing a month after my mom passed, haven't heard anything in 4 years about what could've possibly happened to him. Hang in there and be strong!!

File a dispute for receiving the item NOT as described, but I would NOT say that you didn't receive it since you already had correspondance with the seller regarding the state the item was in once you received it. He most likely will produce that email if you try to say you never received it. Just my 2 cents. Also, I have sold plenty on ebay and never been told that it was my responsibility to insure the item as the seller. Good Luck!

Truth of the matter is, both of you got screwed if it got damaged in transit. Remember the seller is probably as aggravated as you over it. Calmly try to work it out with them.

You guys are all missing the point. USPS damaged it not the seller.
With or without ins it's not the sellers fault the carrier damaged it.
It's the the carriers fault. His dispute is not with seller but with USPS.
Is seller supposed to rectify situation because the people delivering it messed it up?
When you buy thru ebay and pay with paypal you have option of buying shipping ins and he must have declined it. Again not sellers fault or responsibility.

Sorry about the damage but I bet it could be fixed for a little bit.
Pics would help.

And condolences on you and your families loss.

Look closely at the pictures fromthe auction and try to see if you can tell if it was already damaged before it was shipped. I ordered a Chinese knock-off rear hump and it didn't fit at all. Tried resolving with seller and they wanted me to pay to ship it back to them when it wasn't as pictured and didn't fit. Filed dispute with eBay and ended up getting a full refund. In turn I bought a used oem one for the same price. They never contacted mento get the pos one back, so I waited a while and just threw it out. Try working with the seller some more and if it is not resolved to your liking, file a dispute - keep all of your email traffic through eBay so that they can see everything if you file a dispute. Erik

Stop buying the super cheap stuff. You'll come up empty handed and pissed off more often than not. Then you end up spending more to fix your discounted parts.

2. Your order arrives, but it's significantly different than it was described
There are a variety of scenarios that meet this condition, for instance:

•You received a completely different item.
Example: You purchased a book, but received a DVD.
•The item's condition was misrepresented.
Example: The listing said new but the item had clearly been used.
•The item is missing parts or features, and this was not disclosed.
Example: The listing said batteries included - but they weren't.
•You purchased a specific quantity of an item - but received the wrong amount.
Example: You purchased five pairs of fuzzy dice, but only received four.
The item was damaged en route to its destination.
Example: You bought a beautiful antique lamp - and it arrived in pieces.
•You received a counterfeit version of the item.
Example: You purchased a Rolex but received a Faux-Lex.

Not my rules and I'm not sure if I agree with it but it's PayPal policy.
That's why I almost always give a shipping quote that includes insurance just to CMA.

How is it that the "ebay seller" ripped you off ???

YOU said that the USPS damaged it during delivery. Contact ebay and the USPS to get things resolved...did you ask the seller to insure it ???

I think the seller is stating that USPS damaged it however he could not find the broken piece therefore making it the sellers fault as the item was broken before it was shipped.
