You need to contact an attorney; call the local Bar Association, and ask if they have a list of attorneys who handle traffic violations. The violation may be the result of a local ordinance.

Your attorney may also be interested in contacting the local ACLU chapter, since the alleged "violation" may be a pretext to silence the content of the message (that is, whatever the alteration is supposed to "mean"), which is a violation of the First Amendment. (That is, unless the government can show a compelling interest in regulating the message.)
 
sorry to hear bout your ticket ... that bunch from LOD has alot suspicion around them, the have several drag bikes that they race, iv seen them at atlanta and bristol dragstrips. lots of rumors about how they fund their hobby. somebody else already mentioned he must have been pissed cause one of them got away from him and took it out on you.
 
if they restrict add-ons to DOT approved helmets....communication devices that attach to a helmet would be illegal as well.

LOL, if you wanna get technical then stickers would also be illegal as they contain an adhesive.:rofl: That whole "officer descretion" thing never ends. I'm not into the hole mohawk thing myself but I dont see why this officer would honestly think it was a problem. He was just giving you crap in hopes that you would buck up and do somehting stupid and when you didnt, then HE had to do something stupid and hope you wouldnt fight it. Good luck when you goto court...hopefully you'll win and the ass will think twice before picking on another biker.
 
Spoke with a NC State Trooper. No law exists that you can't have protrusions or mohawk like objects on your helmet. You need to check with your local agencies for an update on local ord. changes.

She shouldn't have to. When I received my driving award in Buncombe Co. last year I had four letters from attorneys wishing to help me for a small fee when I got home. Maybe that's just for out of state folks. Then my brother who lives in the Asheville area went to pay the ticket for me he was granted a continuance for me and threathened to be prosecuted for practicing law without a license.
 
My advice :

Become an AMA member they have the lawyers to fight these things nationwide.:cheerleader:

Second contact the ACLU they live for these kinds of situation.:whistle:
 
they wouldn't sell them if they were aginst the law!!! thats just rediculous!

They can sell them but with a disclaimer on it. Just pay the fine and go on with life....Geeez its $100 its not worth the BS of court and if you piss that cop off guess what hes looking for next time you pass him. If he catches you speeding he'll just haul your ass in for wreckless driving and inpound your ride...Stop being a girl and get over it.
 
Most aftermarket exhaust has the "not for street use" or "off road only" disclaimer. That's not to tell us where to ride our bikes. It's so they can sell it to us. Under tails is another good example lots of people take for granted.

People be amazed on what is legal and what isn't that we take for granted. I have a program that copies DVD's. It's illegal to copy them,but legal to sell the program that removes the encryption on the DVD's. Program comes with a "Disclaimer" on it also. Not that I copy DVD's. I make Backups of ones that I own. :whistle:

See if you can get a written and signed statement from the Capt your brother talked to to take to court with you. Sorry that this has happened, but with you going to court with it, not only helps you, but helps the whole motorcycle community. If you just let it go, what would be the next stupid thing they would be pulling us over for. Can't wait to hear the outcome. Good Luck!!!
 
I would fight it in court and then contact the A.C.L.U. if you feel that this is a PROFILING case, they love fighting that sort of stuff.. We are motorcyclist and we are a minority group as compared to the " usual" motoring public...
 
:whistle:Just wondering how the Hardley types treat you when they see your "hawks". Does their "live and let live" attitude prevail, or do they fall off their bikes laughing and then want to kick your ass?
 
my ticket basically says this --- that i was not wearing a helmet that doesnt comply with the law...

Which means you were indeed wearing a compliant helmet? So, what's the issue? Maybe I am confused by the verbiage........???
