2008 Hayabusa

I had put a deposit down for the 07 RR, but after seeing the 08 Hayabusa I changed my mind. Talked to dealer last week and they were to put deposit back on CC. Called today and Sales mgr said they are not going to give deposit back but force me to buy 07 RR. Should I sue in MAgistrate court or buy 07 RR and then trade it in on 08 Busa? Deposit was on an incoming bike , not one on the  floor reserved. After I put deposit down, I began to hear horror stories of Terrible Customer service there from several former customers.
 
Did you agree that the deposit you placed on the 07 RR was non-refundable when you placed it?
 
I did sign a retail sales contract, but nowhere does it say that the deposit is non- refundable. There was not even a VIN number assigned on the contract. I called another dealer who sold my brother 07 R1 last year and they said that this is highly unlikely. They said in a similar situation they would refund deposit and maybe retain a % for an assigned VIN and bike. She stated there focus is Customer service and repeat customers.
 
They can not keep your money. Most likely you only need to talk to your layer. Or you can just talk to your cc company.

If you are going to talk to your cc company don't contact the dealership any longer, just take action.
 
I wouldn't see how they could keep your money unless you signed something saying that was part of the agreement
 
I know I'm going to get flamed but I think its upi to them. I honestly hope you get your money back and the next day that business is burned to the ground, but this is how I see it.

Contract meaning a legal agreement between buyer and seller.

It doesn't have to. The fact that its a contract says its not.

The contract might simply state you're leaving this money for a particular style of bike. If the dealer can provide that bike, I doubt you have a case.

AGAIN ... I'm rooting for you. I'm just giving a different perspective to what has already been said.

Question though ... how long ago did you leave the deposit?
 
Ooh thats a tough one. See a lawyer in any case if this thing doesn't go your way.

how long did they have your deposit? and did they order the bike for you?
 
The deposit is on a bike on the way in? If so, they have no choice but to give you your deposit back because you have physically never taken delivery of it "drove it off the lot". Doesn't even matter if you signed the papers, if you don't drive, trailer, ect. the bike off of their property it's not yours. I am a manager of a bike shop...
 
I placed the deposit on it in May 2007. Was planning on picking it up in December. I talked to a salesman of another large dealership and he told me since I have not taken physical delivery, that I am entitled to a full refund. Never buy from a Honda dealership in Lawrenceville, GA.
 
Well even with the worst case scenario, I will buy a new 07 RR and then trade it in immediately on the 08 Busa. Wonder how much I can get on a trade in?
 
If you did not sign anything that says you are required to buy the RR....contact your local bank and have them reverse the charges on the credit card, if the dealer does not like it oh well ..its your money not theres.
i would make you buy the RR myself , since no one sales as many bikes as suzuki... hahhahah good luck with the deposit... let me know

OH NO ! dont do that, you will eat it big time. My first recommendation is if the dealer wont cooperate then call Honda and ask to speak with the Dealer Factory Rep, then Talk with your bank or better yet next time use your credit card and you will have even more leverage. They cannot force you buy, and better yet I think you have a stronger case in court if you DONT take delivery.

I can't speak for the laws in your state, but I can tell you for certain...in THIS state..a dealer must return a deposit if the customer asks for it. Period.

If the purchase agreement you signed had no vin # on it...I would bet you are bound to nothing. Steam.

I'd look in the phone book for your local "Dealer investigator". Each state has several individuals that keep dealers in line.

Get your money back, and take your business elsewhere.
 
Sorry, you committed to an RR in which the dealer had to put an order in for to have shipped to you because they didnt have one in stock, now they will get stuck with an RR on the floor (which they probaly can sell)but you put a request in, paid the deposit for it and you have a binding contract showing your commitement on the RR, it sucks for you, u may have to eat the deposit? to buy the 08, they wont refuse to sell you an 08 Busa, but you put an order in for an RR, They delivered.
 
Damn you make it seem so cut and dry. I forgot to ask what law school did you attend? Also your location says Toronto. Are the laws in the state of Georgia U. S. also applicable in Canada? Maybe I missed something along the way. No they did not put in an order for me exactly. If you go the Ford dealer and say I want a Blue F150 in about three or four months. they are not going to order it for you the next day. Thanks for the comments(judgment) but I was really looking for sensible and logical reasoning.

P. S. Also do you remember(LOL) the day you went with me to put the deposit down, There were actually three on the showroom floor. Also thanks to everyone that have shared insight into my situations
 
The moment you roll the RR out the door, you will lose up to 25% of its value as it will then be traded back as used, regardless of mileage. This may amount to more $ than your deposit itself in loss.

I would tell the dealer that you will place a large ad in the local paper regarding their business ethics attitude towards you and your business. You are willing to spend more money with them through the purchase of the Busa. That advertisement will hurt them mor in the long run due to bad business practice - also mention that you will log it with the better business bureau as well as post it on every web site known to man, hoping that they know what a web site is down south here.
Food for thought. Don't get mad, get even, legally that is....
