Ebay scammer???

I posted earlier about the '02 Busa that I just bought on eBay and am supposed to pick it up tomorrow.  I think this guy is trying to scam me so I cancelled the order.

- the auction says the title is clear, but I did a VIN search and it has a lien on it
- the title isn't in the guys name, the previous owners name is still on the title.  He never registered or insured it.  
- in the auction, it says that the bike has never been in an accident, but after speaking the guy, that is true but the bike was dropped and has scratches on one side and the end of the clutch broke off.   The clutch can be replaced for less than $50, but the plastic would be expensive I can imagine.

I posted a link to the auction.  It ended at $6525, but he knocked the price down to $6125 after he told me about the scratches on the phone.

What do you guys think?  Scammer?  I cancelled the order, as I don't feel comfortable buying this bike now.  I think I'll stay away from eBay, its too risky it seems.

Looks OK to me, the guys says to pick it up at his house with cash. Hard to scam you like that!
 
The seller is an azz for not mentioning the damage in the auction. No way would I go through with it. If you look really close at one pic you can see the ball end broken off the clutch lever so it's not like it was dropped AFTER the auction started.
It'll run you just around $1000 to make the left side perfect again. Too much of an investment for a 4 year old bike imo.
 
who knows, could be a relative or something that helped him buy it. Shoot him an email and ask him.
 
What about the lien on the title?  His name isn't on the title either?
Dude, the whole deal is screwed up. Run away and don't look back.
If the title has a lien on it and it's still in the original owners name, who's been making payments? There's a bank somewhere with the title and hopefully someone has been making payments on it, otherwise there's a repo man out looking for it.

Plenty of losers out there that will buy a vehicle with a clear title and never transfer it. Of course they'll ride around without insurance and end up hitting and crippling somebody and the poor sucker that sold it will get hit with a lawsuit since he still technically owns it.
Never heard of anybody pulling that one off when a lien is involved though.
 
He was saying that he bought it from a dealership (a car dealership) who got the bike from someone as a trade in, or something like that. He doesn't know the person, they never met or anything. He never said there was a lien on the bike though, he specifically said the title was clear. Whats up with this, what do you think?

He can always look at it, he may have just bought it recently, never titled it. He wont have the title if there is a lein on the bike, period. If he has the title (check the vin close on the frame and engine) there is no lein. Hell, some guys on the org may go over and check it out for him.
 
If you were planning on going through with this, I would ask him to scan the title and send you an electronic copy. You already know the name that you should see on it. If there is a lien, he could still have a certificate of ownership; that is not a title. Personally, I would not purchase this bike. If the drop didn't come up until you asked him about any damage, what is going to come up when you go to pick it up? As was said, the clutch lever is broken, why not mention that the bike fell, with close up pics of the damage?

I don't think he is a scammer in the sence that we are thinking, I think he is just a dishonest seller. Again, I wouldn't deal with him...
 
I agree, MC. He purposely neglected to say that the bike was dropped until I specifically asked him if its ever been down. I asked for close up pics of the damage so he emailed me the following pic:

The funny thing is, you cannot see those big scratches in the pictures on the auction page. I think those auction pics were taken BEFORE the bike was dropped. I asked him that but he said no.

holy sh*t, I didn't even realize that!  damn, I was going to get SCREWED!
I would never make a big purchase on ebay. You should check the local paper or cycletrader.com and you can surely find a better used busa for a better price. And if you ever decide to buy new, call every dealer within 100 miles and get quotes to use to make the dealers drop their prices. I got my 06 blk/gry for 10,200 out the door... and that's a pretty good deal right there because I called around. I probably could have gotten a better deal than that if I didn't absolutely have to have my blk/gry.... because I wouldn't settle for any other color.
 
This guy still has my $1000 deposit that I paid via PayPal on my AMEX. I called PayPay, but they can't do anything, he needs to refund it to me. If he doesn't do it, what do I do? Call the cops and AMEX to dispute the charge, or should I just go to his house and kick the sh*t out of him, or both?

That's exactly what you do. Don't EVER EVER EVER put a deposit down on ANY vehicle - even from a car dealer - with a check. Use a card, and you've got the weight of a bank behind you in case something like your situation should arise.

if the check hasn't cleared call your bank and put a stop payment on it. tell the the situation it might cost you about $25 but well worth the try
 
I paid with my American Express card, not a check. I'm going to call them after I call the police if he doesn't refund it.

I would have loved to purchase your bike, but you seem to be very dishonest by leaving out vital information in the auction, such as the multiple cosmetic damage and the lein on the bike. Whats up with the damage pics you sent me too? You showed me damage on the brake side of the bike, meanwhile you told me that it fell on the clutch side. So both sides of the bike are damaged, another thing you left out. I also believe that the pics in the auction were taken before the bike was damaged. I showed the damage pics to a Suzuki dealer and he said thats at least $1000 worth of damage, just from the pics that you showed me, who knows what the other side of the bike looks like.

Its been less than 24 hours since you took the money out and its going to take you a few days to refund it? Why is that? I really hope that this matter can be resolved quickly, but if you do not refund my money by tomorrow I'm calling the police and putting a block on the charge on my credit card. If you want to discuss the matter on the phone, call me at home anytime after 6pm at xxx-xxx-xxxx.
