If you've been current with rent, double check with the bank. They may be more accomodating than what you think. Doesn't hurt to check.

Your tenancy is less than 1 year so new owner, whoever it is, is only required to give you 30 days notice of the termination of your tenancy. If you have not moved or taken their CASH, then they will file an Unlawful Detainer action naming you. On the summons, it will tell you that you have 5 days to answer or they will be able to file a default and get a judgment, request a writ for the sheriff to come move you out. If you answer within the 5 day period, then they have to schedule a court date, generally 3 weeks down the line.

Go to the library and get a copy about Tenants Rights and Eviction by NOLO PRESS. They publish a whole series of self help books. Defend yourself....if its war they want; give it to them....
You have about 45-60 days if you answer the complaint

That's gotta be frustrating though, means you've been paying rent to some squib who has then NOT been paying the bank...

I once knew a lawyer who told me about a scam like this

Buy a house in a corp. name. Rent it out, Dont pay the morgage payment, Keep the rent. Takes approx 6 months to get someone evicted from a house.

How do you buy a house with out investing any $$$ in it? Seller is going to want something before the title is transferred.

Now I've heard of people renting out vacant properties that they don't own.

Also, if it helps it can take forever for a short sell to finalize. My brother and sister-in-law have been trying to buy a house in Vegas and all they can find are short sells. They have multiple offers on different properties and they all have been sitting in this limbo state for at least 5 months now with no sign of change. I hear these stories from everybody also. The way I see it you probably have a good 6 months before you'll need to move.

As some other people have said check your rights also. I heard that it's illegal for a homeowner to collect rent once the property goes to bankruptcy, foreclosure, short sell, etc so you could have 6 months of free rent so you could get caught up on other bills or save for a new place. Like I said though I only heard that and haven't been able to confirm that.

normally that's about right but with the rise in short sale and foreclosure the going time frame is about 2-3 months in CA and the house is short selling if I read correctly which changes things a little bit. but really make sure you get your deposit back now they cannot hold it any longer please Boss if you do nothing else make sure you get this done asap I'd hate to see you lose that too
