Sometimes the HOA is just stupid... and then others they are WRONG

I was smart enough not to move in a HOA. Those that choose to live in HOA's know how picky and anal they are and if you still decide to move in those cult communities well then you shouldn't complain.

All neighborhoods in Albuquerque and required to be apart of an HOA. I believe some of the counties here are starting to require them also. If you want to live here you don't have a choice.
 
I live in an HOA and let me tell you, like Blanca said, crooked most of them. They will let their "buddies" do things that other home owners can't... absurd....my HOA forbade 6ft tall fences yet it looked to me like a few were that tall...so I went around and measured these suspect fences and wouldnt ya know it 4 of them were 6ft in height INCLUDING the HOA president. They got around it becuase the top foot was latticed? Hmmmm...then I put a request for a White Vinyl fence I wanted to do myself, they tried to force me to use a contractor and thats where i drew the line...no thanks Im doing it with some certified contractor friends...oh but you cant do vinyl was the story then but the HOA president brother has a vinyl fence...

3 weeks later my 4 friends and I erected a 6ft tall Vinyl Privacy fence on my property...and no one said a peep...the HOA Pres complained to the architectural commitee but they told him "hey if you're brother can do it so can he" since then I have had about 20 HOA members come see my fence, told me they loved it, I told them the story and 12 of them have erected their own...

A year later I erected a 10X20 shed...max size per HOA guidelines? 5X6:laugh::laugh:

I told the architectural committee chairman the HOA can come and take down either one of my structures...but theyre gonna have to get past Oz...and I really don't think they wanna mess w him..

So MY HOA can:moon::laugh:

That's what im talking about, same thing happened in my buddies development, the rules said no sheds or swingsets or play areas in backyards, but the prez brother erected one of them big ass pirate ship play grounds in his backyard and got away with it

Not all are bad, some are just are just on paper with no dues and don't do anything except clean common areas like my old one that was locally managed. Then there are ones that are an out of state business like my new one. We pay dues, they have inspectors who send notices about weeds as soon as they see an inch of green. We have to get approval for everything including paint color and plants. We even have to pay $10 per request. If the see you painting the exterior of your house, they ask to see your approval letter. If you don't have one they try to shut you down and make you get one. I hate this HOA. I an planning a revolt.

Before someone says it, I didn't know it was that bad because I wasn't given the By-Laws until months after I moved in.
 
Read that story earlier and it made me chalk up another reason why I moved out into the country. Also, I would tell them to stick up as well and to come and try to take my flag down. Too much PC crap going on already, NBC edited "God" out of The Pledge of Allegiance during the U.S. Open. This kind of crap makes me sick to my stomach and makes me want to show the people that make these sort of decisions just how good we have it here.

I don't think this HOA is a political correctness issue. Also the pledge was not written with the word god in it originally , that was added in 1954 at thr pressure of Knights of Columbus.

As for HOA they are straight wrong IMHO. Why should someone be able to tell this man he can't have his flag on a pole in his yard? He bought it he installed it on "his" property. The tradition of raising the flag shouldn't be taken because some multi-million dollar corporate pencil pusher declared it. That's up there with Tax enforcers shutting down kids lemonade stands.

In my opinion they changed it to take out the word God because it was being said by a classroom of children that said God during the Pledge.

I apologize for leading this thread off track. A HOA can suck, that is all there is to it. A vet, or any other American for that matter should be able to fly the flag of the United States anywhere they please in this country. If they want to stand on top the Empire State building and fly one, go for it. I feel very strongly about this subject, and think I have said enough to get my point across.
 
You have agreed to their restrictions when you purchased your property in their community. Why would you be upset that the rules are being enforced? You know what they are going in and are paying for their enforcement through your Association dues every month. If you can't live with the rules why would you even consider buying and living there?

HOA rules can be very restrictive. No M/C's, can't park in the driveway or on the street over night, can't leave the garage door open more than 30 mins, can't repair your vehicles except in the garage with the door closed, can't paint your house with out HOA approval of the color, can't do any unapproved landscaping, any and all signs need approval,..........There's no end, some of the regulations can be inches thick. Common sense would dictate reading them before starting escrow.


That's just the tip of the iceberg that my poor old mom has to deal with.
I can't ride over there for a vista as Pardini is right, no bikes allowed inside.
No trucks with lettering on the side are allowed to park unless they are there working or repairing something. Here where she lives it's a bunch of old farts with boring lives and nothing else better to do than look out their window all day long just waiting to catch you doing something and then wham it's 'Attack of the angry Four Footers' :laugh:

So not only do they require you to be in a HOA, do you have to pay those HOA dues also?

The one I am in now has dues of $64 every three months. They also have a $10 application fee for each exterior atlerations or repair to your home (back yard included) Change a plant, $10 for them to approve it. Repaint your house (same or different color) $10 and you have to give them a sample of the paint. Replace shingles on your roof $10. Add a sunroom, $10 plus any fees you have to pay the city for permits. Plus they fine you after the 3rd warning about any violations (warnings are weekly). They put property leans on those who don't pay the fines.

My old one didn't have dues. They had rules about things like junk cars, RVs and major additions to the home. They only thing I ever saw them try to enforce was the RV rule.

If they are crooked, it's because the home owners are complacent and let them get away with it by not attending meetings and demanding transparency and accountability. Why pay for an HOA if it does nothing?

The whole point of an HOA is enforcement of a pre agreed upon set of standards to control the quality of life/living in the neighborhood. The trend towards gated communities and HOA's was driven by the fact that most all developments have CC&R's that were pretty much unenforceable and seldom adhered to. HOA's were formed to be the regulators and enforcers of the community standards. HOA members are paying for them to do just that. Why give them your money and not insist they do their job?

I can't understand the mentality of paying a HOA to tell you, you can't do something you want to do. i.e. putting up a flagpole or building a 10X20 shed.

It becanse some really crazy favoritism drama crap..too entrenched witht he buddy buddy system, I just fought back the best way I knew how, use their rules against them..
 
Sometimes an HOA serves a good purpose. Like when your neighbor won't cut his grass or your neighbor is constantly parking in front of the community mailbox. When they try to tell you what you cna put in your backyard, that is when I have a problem. If I want a pool, I will put one in, as long as I don't build on the easement, what is the problem. I built a pool and got the HOA approval later.
 
It's just funny how the HOA is formed and rules are written before anyone ever moves into the development. They build the gated community, wrote the rules and formed a HOA with only a small group of people without the general consensus of the larger majority who wind up moving there. But it is a bit silly to agree to and sign the HOA bypass and then complain about them. The problem my mother faces is she signed the rules more than twenty years ago. They continue to modify, add and change the rules on the whole community and then there is zero choice to agree or not they are just presented to you that's it.

if enough home owners complain or band together they can "fire" the HOA and have things redone. When I lived in NC my community fired their HOA group because of their inability to uniformly enforce the code....not to mention they got to be just redonkulously expensive for the little service they provided. When the new HOA came in, they changed the bylaws slightly to correct for some inefficiencies in the original code as well as tighten a few others that were constantly being broken, namely the monster travel trailer always parked in the roadway. It was so large you could barely get around it on the narrow community street, the owner refused to move it to their land instead of the street so the community as a whole decided to ban parking of anything on the street overnight.

There are reasons to have an HOA but the ones that get too strict or want to control too much or particularly the ones that apply rules unequally are the ones I cant stand and won't buy into the area where they are anymore. The HOA where we are now says no loud parties after 11pm, keep your lawn/house maintained and no blocking the road....thats it and its $100/yr which includes maintenance of the community beach and entrance :thumbsup:

Where does the money come from to pay for the common area cleaning if there aren't any dues?
