you can still sue her personally.  try to go for her assets, house, car, stocks, retirement funds, garner her wages, etc... Even if she has nothing, keeps her from being able to come back to the "normal" world of having her earnings see the light of day.  Make her work under the table for the rest of her life until she pays up to clear up whatever the settlement/judgement would be.

Seize whatever you can get from her that's a reportable asset.. even her kids if you have too.  Don't know which is worst, her not having insurance or her lying about you running a light when she left turn in front of you.  Sent her lying, uninsured a*s to the beheading block!

If there are traffic camera's at the intersection, you've got it made. If not, you may have a hard time proving what happened. Any witnesses?

Glad to here your OK, there right the bike can be replaced, you cant! My lesson last year was without a jacket, so it was a long hard lesson to learn. My helmet was ground almost all the way through. As you said thank god for gear! Get back on soon it gets harder the longer you wait.

You might know there was no camaras at this intersection, but a lady who stopped to check on me wittnessed that I had a green light.

I could sue her but from the looks of her car and her she probably doesn't have anything to go after. She was driving a little worn out we finance anyone cage with temp tags. She doesn't have Ins. so she can't get tags.

Thanks everyone for all your support I know the main thing is that I'm ok, and believe me I thanked God a thousand times for keeping me safe, I guess it just wasn't my time, but still looking at my baby laying there with all the work I put into it, you can't help but feel something. I'm glad to have had only a scraped knee from this. I don't know how to post pics, but I'm going to take some today. I would appreciate it if someone would post them for me. Thanks. Oh ye and I will be back, maybe I'll wait and see whats new in 07.

Good to hear you didn't get seriously hurt.  I am sorry to hear that the driver did not have insurance.  Is it legal for said individual who you crashed into to drive without insurance? If not, I would suggest that you file a criminal complaint against said individual to ensure that she have "driving without insurance" on her jacket. If said individual is willing to pay for your motorcycle damage, then you can drop the criminal complaint.

KS Statutes 40-3104
It is illegal to drive without insurance.
Jurisidiction: Kansas, USA

Said individual has broken the law.

If said individual has no assets, suing may not be your best option.
