More drama with my bike accident!!

if you let your company pay for your bike as you have claimed here...you will get screwed...by either higher rates or they can drop you. They are paying you under your collision insurance.

yes you can be at unsafe speeds if traffic is congested or weather even if you are below the posted limit


Where did you impact her vehicle? Front fender, door or rear quarter?
 
Well some good news is. If my adjuster will hurry up and get his butt out here get the report done so i can get my money i can start ordering parts and its only gonna cost me about $800 to fix it:thumbsup::beerchug:

if you let your collision pay for an $800 repair...you will pay 10 fold in 5 years.
 
my bike hit her in the driver rear and bent her rear axle and i slid 48 feet past the bike and the car in the other lane

then unfortunately.....Unless you have massive skid marks...or this all happened in front of the cop, you are right....you are at fault.

My bike is totaled but is only gonna cost me $800 if i fix it, Also i have allstate for my car, house, and bike. I have accident forgivness so my rates wont budge and i only pay $700 a yr full coverage with medical and extra accessorie coverage

I hope you luck once they pay for her car. Right now they are telling you this based on the fact they don't know how high the bill is gonna be.

How new was her car? value? Odds are fi you shifted her rear axle...hers could be totalled also.

No i wasnt fined. How am i at fault when she failed to yeild, If i would not have laid the bike over i would have t-boned her in the driver door and i wouldnt be typing this message right now. SO again how am i at fault?

My insurance is not paying for her car they are paying for me only and then going after her insurance she had a 93 pontiac bonneville

I forgot to mention I left a 79 foot skid mark untill my bike hit her car

rule of thumb normally is the door of a 2 door. Behind it...you are at fault...in front..she pulled out in front of you...middle...well gray area.


Per DOT.....you laid the bike down because you could not control it. They do not recognize your stuntman abilities to slide a bike in to reduce braking distance.


Don't shoot the messenger. I am telling you how it is viewed in the "law's" eyes.
 
You were on a major street and she was coming from a side street, from a stop, correct?

You were passing a car that was traveling in the same direction as you were, correct?

You were going the posted speed limit, correct?

Was there any weather conditions, slow/stopped traffic, or a curve with a temporary reduction of speed posted?

Were there any obstructions from her viewpoint? (ie. signage, foliage, people walking on the sidewalk, etc)

Do you have any eye-witness accounts as to what happened that corroborate your side of the events? (Even one would help immensely)

If what you're saying is correct, this shouldn't be your fault. You were riding in your lane at the posted speed limit and she pulled out in front of you too close for you to stop without hitting her.
 
Well the report says 72.1 feet to be correct and it also says "skid marks" i would say the first mark was tire and the rest was bike

your insurance is hoping they won't have to pay for her car based on the info you have given them. Once they get the info you have given me already...you are done

you hit her in the rear quarter
cop states YOUR speed was an issue in the crash
witness not in your favor
79ft of skid mark for 35mph doesn't add up.

this myth is the same as guys who claim if they would have been wearin a helmet, they would have broken their neck


If you bike skid or slid 72+ feet and still had enough force to break her axle......you were going over 35 mph.

I hear this excuse a lot. That excuse is a crock o' ****. If you practiced emergency braking/swerving maneuvers coupled with properly scanning other drivers, looking at their wheels/faces/other traffic/etc, you could have stopped. Laying down your bike doesn't slow you down faster Your brakes slow you down much much faster than metal and plastic scraping on the ground.

You saying, "I laid it down to save myself" = I couldn't properly handle my bike to avoid the crash like I should have.

Laying your bike down increases the distance you slide and ALWAYS ensures a crash.

I'm sure you won't like this but the truth hurt sometimes.

Yes she pulled out from a side road with a stop sign.
I was doing the speed limit and as soon as i switched lanes she was there and there was nothing i could do
There were no weather, traffic, reduction of speed and no obstruction of her veiw
 
35mph= 79ft "skid mark"....seems like a long skid for such low speed.

I lowsided on the highway doing about 35 in rush hour traffic when someone pulled into my lane about 10 feet in front of me from a dead stop. I left at least 79 feet of "skid mark", liquids and debris.

I mean without braking, that's only 2 feet per mph being bled off as the plastic and metal slide across the pavement. Now, if it's rubber "skid mark" due to braking, I agree that's amazingly long for that speed.
 
not trying to be mean man...but be prepared...


and yes...in this situation...might might as well let them cut you a check for your bike.

I am betting they will pay for her car...you might as well get your bike fixed...


and be prepared for the worse...higher rates or dropped policy

maybe they will forgive you...time will tell.
