Road Rage this Morning... Yup

If some guy came up to my vehicle and started punching the window I'd have no problem finding my Glock and puttin' a couple rounds through the glass and into them. It would be totally justified too.
So let me get this straight... If you think you can justify it and get away with it, you will use excessive force, even when you KNOW (or strongly suspect) that it isn't necessary?  Aren't you supposed to be on the good-guy's side?

Not saying my hubby here wasn't out of hand this morning (should have seen me slipping down in my seat - image: The opening scene of National Lampoon's Christmas Vacation)... but come on man - don't you think this image of yourself is a little harsh?
First off, I don't "think" it would be justified, I know it would be. Yer hubby was clearly the first person to act out of line. I quote...

While doing that some dude in a Minivan behind me lays on the horn...  I was kind of irked, I mean where the fug are we going to get to anyway???  We're not going to make this light...  

So, Pissed off and irritated I give the guy the finger as I move ahead to sit at the light...  Well then I look in my mirror and he's giving me the Bird...  I am like "WTF?"  That's like "Double Uncool"...  *Sigh*

As bad as it pisses me off, someone blowing the horn at you when you're stopped in traffic isn't "out of line". It's irritating as HELL, but not inherrently offensive and out of line, per say. "The bird", however, is generally accepted as offensive and likely to enrage another.

Rev was admittedly the first to commit an inherently offensive, rage inducing act and the first and only one to break a law. Well, if it had occured in Georgia anyway... Disorderly Conduct 16-11-39 Open and shut case. I don't know Florida law but most states have similar laws regarding this type of behaviour.

Oh - I never said he wasn't the initiator... I thought the response was a little extreme.  Since when does Disorderly Conduct warrant Lethal Force?  I think you might have a tough time convincing the jury that someone punching your car justified you shooting them in the head...

I don't think that was your point though, was it? I think the point was that I came across like I do whatever I think I can get away with... In that case, you're right. I came across wrong. I did say that I'd have no problem ventilating some fool who approaches my vehicle and tries to punch the window out... and I wouldn't have a problem with that given certain circumstances.  What I didn't really mean to imply was that I'd have shot Rev in the given scenario. Personally, if my blowing the horn had started the whole thing I actually would somehow feel somewhat responsible for the whole mess and would hate to have to live with shootin' somebody over somethin' I technically started. Fwiw, I only blow my horn in traffic when someone is cuttin' me off, or to just bump the horn to get the attention of someone who is "sleepin' at the light" and doesn't realize it has changed.

My intended point was to illustrate how close Rev might actually have been to gettin' his head blown off over some stupid stuff... and the fact that the guy probably would have walked after blowin' him away.  

Also, I don't like armchair quarterbackin' someone else's game. It's easy for all of us to sit here at our computers and spout off about what we would have done to the guy, or what we would have done to Rev had we been the other guy, but...

I'd like to think that if I'd been Rev, I would have just thrown my hands up (no bird) at the guy like WTF, and just cussed him inside my car for the next couple miles like I normally do when I encounter a jerk in traffic.

I'd also like to think that if I'd been the other guy I would have gotten my butt out of the vehicle so I wasn't at such a disadvantage to Rev and dealt with whatever threat level he brought to me as the event unfolded.

I'm most certainly not the type of person who tries to do whatever I think I can get away just because I think I can get away with it. That point couldn't have came across any less accurate.

Hell I was thinking disorderly conduct minimum, then rounded up to destruction of Private property if the window had broken, then we would have been looking at freaking Assault and Battery or Aggravated Assault? maybe simple assault as a minimum. So yeah, I might even end up with real jail time... NOT MUCH, but still BIG HASSLE...

BT, What's the punishment in Georgia for A&B, VS AGRO Assault, VS Simple Assault? Do you happen to know off hand?

Disorderly conduct in and of it's self does not justify deadly force. However, placing someone else in fear of receiving bodily harm, or being killed does though. Given Rev's size and "look", the fact that the guy was still in his vehicle (shows no intent to take the fight to Rev and proves intent of Rev to bring the fight to him. Rev struck the vehicle, proving a threat of violence was present... guy would have been defending himself from a vulnerable position, no avenue of retreat/escape available... etc...) and the fact that you'd no doubt have several witnesses that didn't see anything other than Rev getting out and attacking this man I'd say skatin' on the shooting would be cake.

The guy shooting Rev would have been justifiable to a jury, no doubt. I don't see how he could be considered "justified" without guilt though based on his stupid use of the horn in traffic.

Up to 1 year in jail and $1k in fines for misdemeanors... At least 1 year in jail and $1000 + for felonies... Agg. Assault is a felony. Would pretty much require you havin' a weapon of some type when you went after him. Agg. Battery (felony) covers a good & thorough tail beatin' when you leave a part of his body mangled or non-functional (broken jaw, nose, broken bone, busted ribs, etc...). Simple Assault is a misdemeanor. Simple Battery is also a Misdemeanor I think (touching someone in an offensive manner, not sexually). Simple Assault is a misdemeanor and pretty much covers what happened with you this morning if they wanted to go with that instead of Disorderly.

The way it went down, Mrs Rev prolly wouldn't have had to spend more than a few months up North without you. In all likelyhood though you'd probably get probation, pay a fine, and be on your merry way. That's how it usually goes here as long as nobody gets hurt.

Ideally, shouldn't the they be the same? Ideally, a jury should approximate an actual accounting of blame. Anything else is playing the loopholes in the law.

Some of it's flaws are necessary though. By confining the jury to basing their decisions on the strict letter of the laws and the facts presented, and forcing them to exclude any emotional kneejerk reactions from their decision making process the flaws tend to favor those who may be falsely accused. If outright reasoning and common sense could be guaranteed things might be different. Unfortunately, reasoning and common sense rarely play a part in today's society. How could juries be expected to be any different?

Sorry Mrs. R, I gotta side with BT on this one.
Once you take the incident out of context and
the Defense Attorney puts his spin on this
getting the driver convicted would be pretty
hard. Remember rev wouldn't be there to tell his
side. the driver could say he thought Rev had a
knife. Yada Yada Yada. the jury woulsn't have
any counter information. Rev got lucky on several
accounts. Alls well that ends well!

See now today I didn't Shave... Nope went all scruffy... And you know what? I think we are onto something.

I mean this morning the Stupid BEeeyotch at the Starbucks Coffee walked away from her drive up window to do "Whatever" leaving me and MRS eyeballing our drinks without means to actually get them. Now we have had problems with this particular person before, she's just honestly rude.

Did I get excited, did I yell and carry on? Nope! I just left, I'm like OK, Enough of this, we are going to the land of Starbucks, I don't need this Rookie hour Hassle.

Now the Mrs. was a little *Grrr* at me, (she wanted her Mocha) but she was supportive...

Anyhoo, then I just about get broadsided by an 18 wheeler.... Interesting and kinda funny really. Then I approach an intersection where I need to turn left. Well on one side of the road I am turning onto there is a car turning right, in the other lane is a car turning left... It's only a two lane road... So, Yeah I aim for the middle and hope these fools can figure things out enough to actually move.... And they Do... Welcome to Florida...
